What these terms are
They are the contract between the gym that signs up for Brod —or the trainer who uses it for their business— and us. They are accepted when the gym is registered, with the checkbox that names them, and are stored with their version and date.
They are read together with two other documents that are part of this contract:
- Brod's terms of use, which say how it is used;
- the data processing agreement, which says what we do with the data of the gym's athletes. If anything here conflicts with it, on data matters the agreement prevails.
Business customers only
Brod is contracted only for a professional, business or non-profit activity: a gym, a centre, a club, a self-employed trainer. Whoever registers the gym declares that they do so on its behalf and not as a consumer, and that they can bind the gym.
For that reason the 14-day right of withdrawal for consumer purchases does not apply. If a person signs up as a consumer despite this declaration, they tell us at legal@profblu.com and we refund what was paid for the current period.
Brod charges athletes nothing: the gym pays.
Who provides the service
Germán Ezequiel Laso Andino, libero professionista, trading as ProfBlu. Partita IVA 04702090988, codice fiscale LSNGMN88S04Z600M, not registered in the Registro delle Imprese. Contact address: Via della Sega 1, 38080 Verdesina, Porte di Rendena (TN), Italy. Email: soporte@profblu.com.
What is contracted
The use of Brod —the athlete app and the gym dashboard— in whatever version is live at any time, for the gym, its staff and its athletes. It includes hosting the data, updates and the support described below.
It does not include custom setup, loading old data, in-person training or usage extras (for example, the dashboard assistant beyond what is included), which are paid separately and shown before they are spent.
Six months free
Every new gym uses Brod free for six months from registration, no card needed, once per gym. The dashboard shows the day it ends. Before that day we send a notice with the price and the pay button. If nothing is paid when it ends, the section "If payment is not made" applies.
Price
Brod's price is the one shown on the price card at brod.profblu.com and in the "How you pay" step of registration at the time of signing up: a fee per month or per year, which includes a number of athletes, and a price for each additional athlete. These terms do not repeat the figures: they refer to that table, and the one in force when signing up is stored with the acceptance.
Prices are shown excluding VAT. The invoice adds whatever tax applies according to the country and tax status in the gym's billing details.
Additional athletes are counted as the athletes active on the day each period closes. The number given at registration is used to work out the price, not to charge.
Payment and renewal
- Payment is by card through our payment provider (Stripe). Card details are handled by Stripe; we do not see them.
- Each period comes with its invoice, which is viewed and paid from the dashboard. There are 15 days to pay it from the date it is issued.
- The subscription renews automatically at the end of each month or year, for the same period and at the current price, unless cancelled beforehand.
Price changes
We may change prices. If a change increases what a gym pays, we notify it by email and in the dashboard at least 30 days in advance, and it applies from the first renewal after that period. If the gym does not agree, it can cancel beforehand at no cost. An annual plan keeps its price until the paid year ends.
Cancellation
- The gym can cancel whenever it wants, from the dashboard, without giving reasons. Cancellation takes effect at the end of the current period: until then it keeps using Brod as normal, and that period is invoiced.
- Amounts paid are not refunded, unless the cancellation results from a price change, from us closing Brod or from a breach on our part: in those cases we refund the part of the period that could not be used.
If payment is not made
- If an invoice is not paid within its 15 days, we notify the owner of the gym and give 10 more days of grace. During that time Brod keeps working as normal.
- Once the grace period ends without payment, the gym becomes read-only for 60 days: staff and athletes can log in, look things up and download all the data, but cannot add or change anything. It is reactivated on payment.
- When the 60 days are over, we notify by email and, 30 days after the notice, we may delete the gym's data in Brod. The gym can ask us to delete it sooner. Backups are deleted automatically on their cycle, currently 35 days.
The same applies, from the last day of the paid period, to a gym that cancels. Invoices are kept for the period required by tax law.
Availability and support
- We strive to keep Brod available all the time, aiming for 99% of each month, excluding announced maintenance. It is a target, not a guarantee with compensation.
- Support by email at soporte@profblu.com, in Spanish, English or Italian, with a first reply within two working days.
- We may improve or change features. If we withdraw an essential feature, we give 30 days' notice, and the gym can cancel with a refund of the unused part.
What the gym is responsible for
- Providing true and up-to-date registration and billing details.
- Looking after its staff's access: whatever is done by someone logged in with a gym account is the gym's doing.
- Using Brod for lawful purposes and meeting what the data processing agreement requires of it as controller of its athletes' data.
Suspension
We may suspend an account, with prior notice except in an emergency, if it is used for something unlawful, if it puts the service or other people's data at risk, or if there is a serious breach of these terms that is not remedied within 15 days of notice.
Liability
- Each party answers for its own part. We are not liable for the training decisions the gym makes with Brod nor for the data it enters.
- Except for wilful misconduct or gross negligence, our total liability under this contract is limited to what the gym paid us in the 12 months before the event, and does not cover loss of profit or indirect damage.
- This limit does not apply to what the law does not allow to be limited, nor to our data protection obligations towards the people concerned.
Changes to these terms
If we change these terms we give 30 days' notice. If the gym does not agree, it can cancel beforehand at no cost. Each version keeps its date; the one each gym accepted is stored.

Governing law and courts
Italian law applies, being the law of the owner's domicile. The courts of Trento (Italy) have jurisdiction over any dispute. Before getting there, write to us at legal@profblu.com.
Express approval of clauses
Under Articles 1341 and 1342 of the Italian Civil Code, the gym expressly approves: automatic renewal ("Payment and renewal"), price changes, cancellation without refund, "If payment is not made" (read-only and deletion), suspension, limitation of liability, changes to these terms and the courts of Trento.
